I woke up this morning to a $500.00 ticket on my car for parking in a handicapped spot here in my apartment lot.
I've always heard that even if the logo is painted on the cement, it still isn't technically a legal handicapped spot unless there is a sign in the front of the spot that designates it.
In my case, the logo was painted on the cement but no sign up front, so I parked there. Can I fight this in court? I keep doing google searches and haven't found anything.
You guys know anything? Aww shucks, 500 bucks sucks.

Here in VA there has to be a sign for it to be a handicapped space. It used to be just the painted in the lots but when they would fade people couldn't tell so they changed the law.

A bit of a different situation....
A guy in a pot club I was in got his car towed for being in the wrong half of a parking lot. There was no sign near the spot, just a small unclear one near the entrance. He took it to court and he won. The judge verbally tore the towing company a new asshole, saying they should know the state laws and that they were risking having thier license taken away.
Fight it. $500, it's worth it. Take a few pictures, bring it to court.

Don't park in handicapped spots? That may be the lesson to be learned.
I got one back in 2004 for the same thing. Every single spot in the parking lot was taken except the handicapped one because I guess everyone that night decided to have company over... I got a $125 ticket and I paid it.
I also moved from my apt complex for that shit because it always was a hassle.

I design parking lots for a living as part of my job. There HAS to be a sign there for it to be legal. The reason is that they move handicap spaces all the time, and it's hard to get paint off of asphalt, but you can move signs all day long.
Of course, if the bit on the asphalt is really freshly painted and there isn't another space nearby that the H/C spot obviously was moved to, you're probably screwed unless you have a lawyer well-versed in the ADA.
And, of course, local ordinances may render everything I've said here bullshit.

4.6.4* Signage. Accessible parking spaces shall be designated as reserved by a sign showing the symbol of accessibility (see 4.30.7). Spaces complying with 4.1.2(5)(b) shall have an additional sign "Van-Accessible" mounted below the symbol of accessibility. Such signs shall be located so they cannot be obscured by a vehicle parked in the space.
A4.6.4 Signage. Signs designating parking places for disabled people can be seen from a driver's seat if the signs are mounted high enough above the ground and located at the front of a parking space.
Oh, and if it's a non-conforming space (not meeting dimensional reqirements for length, width and access aisle) you might be able to argue that it's not a legal H/C space.

Unfortunately, the number of spaces is dictated by square footage and use. Like 1 per 2000 s.f. So a giant retail box like Home Depot needs a zillion HC spaces, even though you'll never see that many crippled customers in the place at once.

The only thing that pisses me off is people who have a handicapped plate/placard because they transport someone who is handicapped, but park in the spots even when they don't need to (i.e. when they are out by themselves).

At my apartment complex, the cunt former property manager would not listen to me about requirements for an van accessible parking space and gave me a hard time for double-parking out in the back of the lot (where I was clearly out of the way for all the walkies to be close). Legally, the complex just barely meets the legal requirements, but at least there's enough space for me to double-park so I can get in and out of the gimpmobile.
However, to the OP, you could go to court to fight it because of the lack of sign (if there really is no sign or you might be too stupid to notice one), and you'll look like a douche, but I don't think that matters much to you.
Pay your stupid tax and be glad that your car wasn't destroyed with a permanent marker or something worse.

Does the sign or no sign law vary by state or is it national? If national, take pics and quote law given earlier and try to fight. If there is a chance of variance then just take it and don't fuck up again.
Another question is will it put points on your licence? in NJ (last I heard) if you park that way it might put 2 points on your licence.

i'd fight it. what happens in the winter when the spot is covered in snow, and you can't see the markings in the spot? no sign, no h/c parking spot.

Have you ever been in front of a traffic court judge? You're lucky if they can read.
But out of curiosity is that a federal ADA requirement, or just the regulation from your state? I have seen a few handicap spots without signage lately, now that this thread brought my attention to it.

That's my mom - fucking 70 year old picture of health, my dad has the tag 'cause of two broken hips a while back - but she'll use that f'ing tag all the time.
On another note regarding the ratio of building size/#of spaces - How loyal would you be if the place you shopped at put an APPROPRIATE number of spaces up close, and the rest way the fuck out in BFE? Me-I'd give them every shopping dollar I spend for having the balls and common sense.

just go to court and fight the ticket. walk up to the judge with a severe hip limp. say you've had the limp since birth. my friend did that and it worked. and he truely does have a limp. judge never asked for proof because of discrimination.
its like a judge asking to prove you have aids. and you them to bend over and wait 6 months before they test.

I park in the handicap spots at Ballys and walk on the eliptical for my physical therapy. I also walk laps in the pool but that was all before my last spine surgery. I cant do shit right now but I would like to. Im stuck in bed eating mush and farting all day. I never knew oatmeal caused so much gas.
So stay out of my spot cuz I'll be back bitches!
