Man's Death in Fight With Cincinnati Cops Probed

CINCINNATI — A police videotape shows a 400-pound man lunged at officers as they repeatedly struck him with metal nightsticks shortly before the man died.

Black activists say the death Sunday of Nathaniel Jones (search), 41, was another example of police doing little or nothing to stop deaths of black men in encounters with police in recent years. The fatal shooting of an unarmed black man by a white police officer in April 2001 prompted three nights of rioting in Cincinnati.

Mayor Charlie Luken rejected black activists' demand Monday that he force police Chief Thomas Streicher Jr. to resign.

"What I saw was a 400-pound man violently attacking a police officer in a manner that put the lives of police officers at risk," Luken said after viewing the videotape, which police released to the media. "While the investigations will continue, there is nothing on those tapes to suggest that the police did anything wrong."

Luken said he agreed with the initial police assessment that the officers who struggled with Jones defended themselves as they were trained to do when attacked. The mayor has rejected previous calls by the activists for Streicher's firing or resignation.

"How many of our people have to die before the city decides to do something about it?" said Nathaniel Livingston Jr. of the Coalition for a Just Cincinnati.

Police spokesman Lt. Kurt Byrd declined to comment about the activists' demand. Streicher is out of the city on vacation.

Assistant Chief Richard Janke said Sunday that initial examination of the videotape showed that two officers were attacked by Jones and responded appropriately to defend themselves.

An employee at a fast-food restaurant called 911 at about 5:50 a.m. to report that a man had passed out in the grass outside. Emergency personnel arrived and reported that the man was awake and "becoming a nuisance" at the restaurant, according to a tape of police radio transmissions.

Police officers Baron Osterman and James Pike, the first two to arrive, were shown on videotape striking Jones after he was warned to stay back. Jones then lunged at an officer and knocked him down. The officers kept yelling, "put your hands behind your back" as they struggled to handcuff him.

They called for an ambulance when Jones appeared to be in distress. He died within minutes of arriving at University Hospital, Janke said. The reason for Jones' behavior is not known, Janke said.

Osterman, Pike and four other officers who arrived to help them were all placed on administrative leave, which is police policy while investigators examine any incident in which an encounter involving police results in a death.

Black activist groups started an economic boycott of Cincinnati after the 2001 shooting of Timothy Thomas, 19, who was wanted on prior charges of fleeing police when he ran from officers. Officer Stephen Roach shot him in a dark alley and was later cleared at trial of criminal charges.

The shooting led Cincinnati to request a U.S. Department of Justice (search) investigation. That resulted in Cincinnati's April 2002 agreement with the Justice Department to tighten policies regarding police use of force and to improve handling of citizen complaints against the police.

On Feb. 9 this year, a Cincinnati police officer chased and fatally shot a former prison inmate who was spotted running from a sportswear store that had been broken into, police said. The police, Hamilton County prosecutor and the Citizen Complaint Authority review panel concluded that officer Michael Schulte was justified in shooting Andre Sherrer because Sherrer had grabbed the officer's nightstick and was beating Schulte with it.

Sherrer's death was the third fatal shooting involving white police officers and black suspects since the 2001 riots.

First off he didn't listen to the Officers orders. Second he strucked the one Officer and continued fighting with them. They had every right to do what they did.

I just saw on the news that the man had cocaine and PCP in his system. The videotape clearly shows that the cops followed training and procedure to the letter. (I probably would have shot the fat fuck.) So according to these "activists" if a 400 pound violent druggie keels over after assaulting police, it's the city's fault? God, I hate those fucking assholes.

People are so goddamn stupid. Because of that Rodney King nonsense they think that cops hitting someone with their nightsticks means that they're doing something wrong. They're not. Why the fuck do you think that cops are issued nightsticks in the first place? So they don't have to shoot violent out of control assholes like the tubby fuck that dropped dead.

Here's a little simple math for the assholes who are blaming the cops for that idiot's death:

Bengals: Fullback arrested for peeing in public

Fullback James Lynch was arrested by police early Tuesday morning after urinating in the middle of a street, fleeing from officers, and resisting arrest. A member of the Bengals’ practice squad, Lynch was charged with five offenses and appeared in Kenton District Court Tuesday. He returns to court Wednesday to face failure to appear charges stemming from a previous traffic violation. According to court records, police spotted Lynch relieving himself at the corner of Madison Avenue and Fourth Street while his car was stopped at a red light. Lynch saw the officers, finished watering the pavement, jumped back into his car and sped off, according to the Cincinnati Enquirer. He stopped after a brief chase, climbed out of his 1991 light blue Cadillac sedan, and began yelling obscenities at officers, including repeated taunts that they would be unable to handcuff the 276-pounder or get him inside the police vehicle. Court records state it took four officers to cuff and shackle Lynch, who was also sprayed with a chemical irritant and tried to kick out a window of the police vehicle. His preliminary hearing is scheduled for December 10. If convicted of the most serious of the five charges, felony fleeing and evading police, Lynch could receive a five-year prison sentence.

CINCINNATI - The death of a 350-pound black man who collapsed after being clubbed by police in a videotaped beating was caused primarily by the struggle, the coroner said Wednesday in a case that has heightened racial tensions.

Hamilton County Coroner Carl Parrott said Nathaniel Jones, 41, suffered from an enlarged heart, obesity and had intoxicating levels of cocaine, PCP and methanol in his blood.

He said the death will be ruled a homicide, but added that such a decision does not mean police used "excessive force." The coroner said he had to rule the death a homicide because it did not fall under the other categories: accident, suicide or natural.

"Since the struggle was the result of a purposeful act, in this case, the effort by the police to subdue him, to do their jobs, that purposeful act was a primary cause of death," Parrott said.

Black activists say Jones' death was another example of police brutality against blacks in a city that was rocked by race riots two years ago. That unrest was sparked after a white police officer shot and killed an unarmed fleeing black suspect.

But city officials have said the officers in the current case were properly defending themselves against a violent suspect. The officers _ five whites and one black _ were placed on administrative leave, which is standard procedure.

The struggle occurred early Sunday after an employee at a White Castle called 911 to report that a man had passed out on the lawn outside. Emergency personnel arrived and reported that the man was awake and "becoming a nuisance," according to police radio transmissions.

The first two arriving officers were shown on a police video striking Jones after he ignored orders to "stay back," took a swing at an officer and put his arm around one's neck.

The officers later knocked Jones to the ground and fell on him, and jabbed or clubbed him with nightsticks at least a dozen times over several minutes until he was handcuffed. They kept yelling, "Put your hands behind your back!" as they struggled to handcuff him.

Jones' body had bruising on the lower half, but did not show signs of blows to the head or organ damage, the coroner said.

In Jones' car, police found cocaine and three hand-rolled cigarettes that had been dipped in methanol, an ingredient in embalming fluid that gets people high, authorities said.

His death certificate will list a cause of death as an irregular heart beat because of a stress reaction from the violent struggle, Parrott said.

The ruling came shortly after lawyers for Jones' family called for an independent investigation, claiming the coroner has mishandled past cases.

"It's hard for me to believe anything that comes out of the coroner's office," attorney Kenneth Lawson said at a news conference.

Relatives said Jones was a loving person who never hurt anyone.

"They talk about Skip like he was an animal," said his grandmother, Bessie Jones. "He wasn't. Skipper was just a good old, fat jolly fella. He wasn't violent."

"Everyone he met, that he touched, loved him," said his aunt, Diane Payton. "He was never mean."

Parrott said he has full confidence in his office's findings.

"We're doing things in the way everyone else does it. We're doing it to national and international standards," he said.

John Ester, spokesman for the prosecutor's office, said the office was in the preliminary stages of investigating the scuffle and was still awaiting the results of a police investigation.

Phone messages seeking comment on the coroner's ruling were left with police.

There are legal reasons why the coroner had to use "homocide" as the official ruling. The main thing is that there really wasn't a category for this type of thing.

homocide is used whenever a person dies at the hands of another human being.

when criminals are executed, the death certificate states cause of death as (heart attack, external, internal bleeding, electectution...etc) due to HOMOCIDE. or something to that effect. but it always states the death as a homocide.

doesn't matter the manner of death, as long as it is done by anothe human being.

just saw it on discovery the other day. dr. michael boden (think thats his name, he is some big time coroner) explained it.
