He's not selling the number itself - he's selling his authorization for Verizon to transfer the number to someone else.

Well with the new rules it;s a grey area now... you can take your phone number and turn it into a cell phone number with any cell phone company... So he is testing it out... I'mguess Verizon isn't carring too much since they would have done something about it already..

Way back in the 80's, when guys would approach me, they would ask my name, I'm Jeri, I would tell them Jenny.And of course that was the phone number I gave them.I worked for the phone company.There is no way somebody could sell that number.Fuckin Verizon....

I love the other "JENNY" auctions that have come up. 1 guy took a jar and wrote the number on a peice of paper and is selling it.. There is some funny stuff.. Just search 867-5309 in ebay's search and see what comes up.

There seems to be some controversy over whether the guy can legally sell the rights to the number. Even the phone company isn't really sure.
The auctions were put on hold until eBay could determine whether they fell within the company's guidelines, a spokesman said Tuesday night. "People are really creative," said spokesman Henry Gomez. "And this one had us scratching our heads a bit."
Buyers and sellers on eBay enter into a binding contract, he said.
So officials of the auction service have to make sure the seller actually owns the item for sale and has the right to sell it.
He said a determination would be made about the auctions after the sellers and phone companies involved had been consulted.

The lawyer who owns the New York "Jenny" acquired it a few months ago after he called it and realized no one had it. He got the number from Verizon and has used it as a second line, hooking it up to an answering machine.
Verizon said its customers don't own their phone numbers, so the right to 212-867-5309 cannot be sold.
But in Nashville, a spokeswoman for BellSouth said nothing prevents a customer from transferring a number to someone else.
This is sometimes done for business partners who split up and the other person takes the number, Sybil McLain said.
"What two parties do between themselves is between them," she said. "We provide phone service."

The new FCC rules allow you to take your home phone and turn that number into a cell phone.. The other rule allows you move your number from 1 cell phone company to another phone company.. So I can take my verizon home phone number transfer it to a cell number and then take my number to NEXTEL or any other phone service... Verizon has to allow the move...
The guy was testing out the new rules..

This is the same as with the one rate programs that are out there right now. For example, I had Verizon for local, and MCI for LD. Then I moved everything to MCI's one rate program.
Now, I moved that number to Vonage (http://www.vonage.com).
There's nothing Verizon can do about it! They're just pissed they didn't think of it first.
