Should All Radio Be Created Equal?

Saul Levine's Mt. Wilson FM Broadcasters has petitioned the FCC to include an indecency provision in the rules that govern satellite radio. Levine's argument is that satellite radio is not heard exclusively by subscribers and that it should be subject to the same rules as terrestrial radio.
"The key is to have a level playing field," Levine told FMQB. "The FCC has the authority to regulate satellite radio and in fact already does regulate it in two respects: The EEO requirements that apply to radio stations also apply to satellite radio, and the rules on political broadcasts also apply to both. The FCC said back in 1997 when it authorized satellite radio that they would revisit, at a later time, additional regulations."
Levine noted that he is not trying to "curb Howard Stern or curb anybody, we're just saying that whatever rules that apply [to us] should apply to them too."
He continued, "Their defense is that they're 100% subscription, and therefore only people who want to hear obscene language will hear it. But they're not 100% subscription. They make it available to car rentals without any charge and there are no controls on it - families rent cars and they can pick it up. It's a misconception that satellite radio is subscription radio. It's not true - the FCC said they can sell advertising or have subscriptions - they can do either. So it's not subscription only. It's not 100% commercial free. It is going to be available to minors. So the bottom line is, we're not trying to impose any censorship on satellite radio that there isn't already on terrestrial radio."
Levine's petition was filed on November 5 and it asks that the FCC open a Notice of Proposed Rulemaking that would mandate that no satcaster "shall transmit any material which is obscene" and that indecent material should be prohibited between 6 a.m. and 10 p.m., just as it is with terrestrial radio. It could take three months to a year before the FCC will rule or act on the petition, Levine said.

A few things to keep in mind:
#1 - This is not the first time someone has tried this shit and it won't be the last.
#2 - This assholes arguement is flimsy at best. In fact it's the lamest I've seen yet. Most rental companies that rent XM/Sirius equipped vehicles charge the customer extra for activation, and those that don't the rental company still has to pay for their subscriptions. Hence whether it is the company or the customer flipping the bill, it is still subscriber based. At most this particular petition would force all rental companies to charge customers extra for XM/Sirius service.
#3 - Retarded petitions like this are the very reason we have to pay $2 extra a month for O&A. Even if in the future the FCC found a way to regulate XM/Sirius content they still won't be able to touch premium tiers (the old HBO arguement).
#4 - Both XM and Sirius have anticipated this bullshit from the begining and each have a fleet of lawyers ready to fight to the death.
Relax and continue to enjoy the best radio service on the planet.

Understand, there are so many differences between broadcast and sat radio. People do have to subscribe, yeah maybe the people who get it in their cars have it free for a year, but they still have to activate it, plus they have the ability to lock out channels that they dont want their precious little children to hear. It will be a very hard fight on their hands.

And there is no cursing on the regular channels. And in my opinion Sirius has a problem with Hoo-hoo if the fcc decides to do something. There is no way they cannot charge for hoo-hoo now.

Then whats the point of having satilite and paying for it? If it is all the same less people will subscribe and there will be more commercials, just making it more commercial radio. This won't happen but I do think there will be some restrictions later, and O+A will end up crossing that line probably. Then you will have to buy bootlegged tapes of the show which will be broadcast from some island offshore:icon_mad:

As I said in another thread on this, I think this is fantasic. I really HOPE the FCC is stupid enough to try this because as soon as they do it has the same implications of them stepping in to take over satellite TV which includes a lot of shows that people aren't going to be willing to give up. Look at the Sopranos, Deadwood, Real Sex and others that liberally throw around language and adult situations all the time and people love it ... and HBO is availabe in a lot of hotels for free.
Every other word in Deadwood is cunt or fuck and at this point the show wouldn't work any other way.

Here is the most important part of this whole thing. Regular radio companies are scared, scared shitless! They see they are losing market share on a daily basis. I don't know about anyone else but I have not listened to regular radio since the day I got my XM and I'm not missing it at all. Mr. Levine's concern is "a level playing field"! That is what it is all about. Owners of regular radio have tried from the very beginning to keep satilite radio from coming to be. Back when the FCC was looking where in the frequency band to put the sat signals the major radio figures stepped in and tried to get the amount available made so small that it would be difficult to broadcast!!
