That's fine. Intent is intent and that proves guilt or innocence.
But is it really a good idea to increase a sentance just because of what someone was thinking? Isn't that a form of thought control?

If someone committed a crime and it can be proved, it shouldn't be important what they were thinking when they did it beyond intent.

But hey, my approach is rational and fair and therefore sometimes doesn't really make sense to lawmakers.

From what I understand, a "hate crime" is a crime commited specifically because of the person's sex, gender, race, whatever. Not because you want their purse or money. The problem I have with it isn't with them determining guilt or innocent. They use it while determining the length of the sentence. If you can beat the fuck out of someone like the guys in this video you deserve the maximum sentence. I don't think your motive or frame of mind should come into play at all. You are a savage, and lets send you away for a VERY long time. White or black or whatever, if you are capable of an act like this, then you are waste of life.

There are 2 chapters on race in that book that you might find interesting. I've read the whole book except for the final 2 or so chapters. Real good read in general; you may find it interesting.

Oh, and personally I don't give a crap what color the people in the video are, they're acting like a bunch of animals.
However, re: hate crimes, I think what a lot of people have a problem with is a perceived double-standard in applying the hate crimes label. Especially when they do feel that a good portion of black-on-white crime is more or less racially motivated.

I don't know man, you may have something of a point to some extent, especially as to how one might feel, but for this situation it seems a little far-fetched.
And I think one of the guys was white, anyway.
Still, something to think about anyway. I'm sure you don't like feeling that other people think you're a criminal just because you're black, and you are definitely justified in feeling the way you feel.

In my opinion, Hate Crime legislation is fundamentally flawed, just as affirmative action is. The laws may have started as a good idea but may have been warped by the left.
If these three “perps” would have been white and the victims were black (regardless of hate group affiliation) it would be prosecuted as a hate crime. It is a double standard that needs to change. Get rid of all of it, it is all garbage.
I would consider these 3 terrorists and nothing more. They try to get their way by using force and intimidation. When they are caught, they should get shipped down to Camp X-Ray at Guantanamo Bay and dealt with there. As should all gang related crimes, regardless of race or nationality.
