"Encouraging fans to intervene in live news shots is inappropriate and dangerous. Today a fan sounded an air horn in a reporter's ear and this action may result in permanent hearing damage for the reporter who was harassed. Reporters are professionals who provide a great service to the public by delivering news. They should be treated with respect and not antagonized as part of a radio show gag. I won't tolerate anything less in our state. The person who committed this act should be prosecuted to the fullest extent of the law. I wish Mr. Johnson a speedy and healthy recovery."

Probably said before, but disturbing the peace, and possible assult. If nothing else there could be a civil suit. The reporter could prove that hearing loss has irrepitadly hindered his careere in broadcasting. If that is so, then the person responsible could be liable for sallery for 20 years. at an average of 80,000 $ a year that would be 1 million 600 k. at the very least.

He said no, He then said that I used to listen to them when they were on WBCN and thought it wasa great show? I just looked at him in disbelief. I asked him if that XM radio was on and he said yes and that he likes XM, I then told him that OPIE and ANTHONY were on XM and he said Really, He didnt know that. He then asked me when they were on ? Needless to say this conversation was getting creepy because I still didnt beleive what I was hearing.Before I went any further with the conversation I asked him how long has he been listening to XM and he said for a few years now, having a Roady 1 It wasnt hard to beleive him. I told him you can hear them right now because of the replays. He asked me what channel as he got in his car then I saw him manually tune in 202, then what I saw blew me away. Good post, but I don't think XM is worried about hurting feelings. They are competing with Sirius at a time when Sirius is getting all of the heat. I don't think XM wants anything negative about the company out there at the moment.

I hope this blows over. If they are giving out prizes, I am guessing that O&A had the blessing of XM to do the contests. Hopefully they are covered since they always give the do not harm the reporter disclaimer.

I don't know what the law is on this, but I would think that if you blew an airhorn in/near someone's ear with the intent of distracting them and that led to some damage to their hearing, you could be sued civilly for assault. That's where things get ugly, not if this idiot gets charged with disturbing the peace, which anyone who did an assault on the media could probably have gotten charged with if there were cops around.

Some other points:

1. To the fucking morons (ban me for member bashing if you like) who are talking about how this isn't a big deal and there are 49 other states where you can do your little assaults, just shut your mouth before you look any dumber. All links to the videos have been taken down. The show is making this go away as best they can. If you do the best AOTM ever tomorrow, you will never get mentioned on the air and if you post video on here, I'm about 100% sure it will be deleted. The assault on the media is dead and fucking buried, just let it go.

2. You guys do realize that O&A/XM could get sued for this right? Of course some of you don't. I'm going to leave it at that because I don't feel like explaining it.

As far as I know, no one on the board has any idea. We haven't seen the video, no one saw it live, and details are slim. From the press release it seems as though the person blew the airhorn near, towards, or by the reporter's ear. But honestly, no one knows for sure.
