Not just fired, but XM is going to sue them for breach of contract and will enforce a 10 year non-compete clause. Plus, O&A won't legally be allowed to be in the same room together ever again.

I found O&A about three weeks before SFS.
I paid for the premium O&A as soon as they came on the air at XM.

I can't see how they would get fired over this. First, they protected themselves with the disclaimers, both on-air and the website. Second, there is no way to prove that this guy was even doing this FOR O and A. He could have been from the opposition. Third, they did not try to capitalize on this like they did with Sex For Sam. I really don't see anything coming out of this.

Lawyers suck (until you need one) and they scare the S out of me. I can not for the life of me see O&A as any way liable - they had so many frickin disclaimers on-air and on the website. XM has lawyers making $300k+ a year checking this stuff over regarding their promotion/ bit. This isn't a new bit that O&A sprung on a naive legal staff. That said, I'd hate to be the guy who blew the air horn - hearing loss could be expensive. Good luck Bro.

I seriously doubt they will get fired.

1) On google news the only sources to carry this are local to New Jersey. XM is a national broadcaste and the news just isnt spreading. This may be a big deal in the tri state area but residents in the rest of the lower 48 really could careless about the story. I am sure the number of subscribers outside of the tri-state areaout numbers them.

2) Disclaimers! Also the only liability in this case is the douche bag who blew the horn. I know there are probably a ton of lawyers praying that there can be a liability found back to XM, but it wont happen. People are sueing Viacom left and right over jackass influenced injuries, but the cases have a nusence status. AKA if the judge doesn't toss it out.. slip some cash,

I have a great idea for a tv show that o&a can be on after they get fired from XM. Cause even if they make it through this lil ordeal you know they are gonna screw it up eventually.

So my idea is like that show on Discovery Channel called "I Shouldn't Be Alive" except with lawsuits and we will call it "I shouldn't have a job." And Patrice would be perfect for this show cause he is one of "those people" that ussually doesn't have a job.

I don't see the story picking up any steam. I've watched CNN, FOX, MSNBC and haven't seen anything on it. Checked Drudge Report, nothing. Googled Opie & Anthony, AOTM, nothing to it.

With the shooting of the passenger on the airline today the AOTM story isn't going anywhere in the mainstream news.

For those who were not around for SFS, this really is not as bad. the only thing I am a little worried about is that XM really has no idea of how to deal with this. Who knows what they will do. They also know that they need the bbboys around for when HooHoo starts at the little doggie company.I think they will just have to tone down for a while. How strange is it though that just on Monday, after discussing the tippy Tom bathroom incident from Friday, that Ant says that they are right back to where they were before they got fired fromWNEW?? Wow, cosmic....I am gonna go beat my puggle now!!

There is no comparison to the SFS incident. There are no "organizations" standing up for hearing impaired reporters. No boycotts of advertisers, etc. This will blow over.

An Opie & Anthony fan took the radio duo's "Assault on the Media" contest literally when he sounded an air horn in the ear of WABC-7 reporter Anthony Johnson during a live broadcast Tuesday morning in Ocean Township.

Johnson was at a Hess station on Route 35 shortly after 7 a.m., reporting on the snowfall, when a man carrying an Opie & Anthony bumper sticker lunged into frame. WABC, like most TV news operations, has a policy against televising attention-seeking stunts, so the sound cut out and the camera spun away before viewers got a chance to see or hear the air horn go off.

Ocean Township police questioned the man, whom they would not identify, but no charges were filed. He faces a possible assault charge if Johnson suffered hearing damage.

William McFarland, WABC assistant news director, said he had spoken with Johnson but declined to elaborate on his condition or the station's legal plans.

"The safety and health of our employees is of the utmost importance to us," McFarland said. "We're doing what we have to do to make sure our employees are safe in the field so that we can serve the viewer and fulfill our license."

Greg "Opie" Hughes and Anthony Cumia host a show on XM satellite radio. They were fired by WNEW in 2002 after a stunt in which a couple was taped having sex in St. Patrick's Cathedral.

The duo have an ongoing contest on their show called "Assault on the Media," where they invite listeners to disrupt live TV broadcasts by waving signs, stickers or other Opie & Anthony paraphernalia. Their Web site, FoundryMusic.com, contains a list of rules for the game, including "DO NOT TOUCH THE REPORTER(S) -- You're trying to promote a radio show, not injure somebody." and "Don't pick fights with producers, and don't get nasty with anyone."

"This appears to be the unfortunate and irresponsible act of an individual," XM officials said in a statement. "We do not condone this behavior at all."

Meanwhile, Gov. Richard Codey's office issued a statement of its own condemning the incident.

"Encouraging fans to intervene in live news shots is inappropriate and dangerous," Codey said. "The person who committed this act should be prosecuted to the fullest extent of the law."

The governor has his own history with radio shock jocks. Earlier this year, he publicly feuded with NJ 101.5 host Craig Carton over insulting comments Carton made about first lady Mary Jo Codey.

For those of you who aren't familiar with this, Opie and Anthony have been holding an ongoing Assault on the Media competition where fans attempt to interupt live reporters to promote the show. The rules are simple: get on camera and try to yell "Opie and Anthony, XM Satellite Radio!" with a sign if at all possible. It's perfectly legal as long as you don't touch the reporter.

Unfortunately, an O&A fan took it a bit too far and blew an airhorn into the ear of a WABC reporter. This could be considered Assault (literally) if damage was done. WABC still hasn't pressed charges and we still don't know whether any real damage was done (he's being checked by a doctor) but the beginnings of a press frenzy are already firing up. Why? Because the media hates this stuff, especially anything that exploits their hacky reporting techniques. NJ Governor Richard Cody even issued a statement about this.

Am I condoning blowing the airhorn? No of course not, but I just hope this isn't going to get twisted by the media into something it's not. Still this is great publicity for Opie and Anthony while Howard is on his media blitz. Pushing the limit is something both Stern and O&A are great at doing.

before we throw the fan that used the airhorn completely under the bus, let's make sure he really did something wrong. Meaning, has the reporter actually been injured, and was he a complete ass that put the horn up to the reporters head.

If he simply was within a few feet and blew the horn I think that's in line with past assaults, and it's a 'sucks to be you' to the fan.

I don't think they will get fired for this being that they had plenty of disclaimers and rules on the web and on the air about the the contest.
NJ Governor Codey got involved with this mess because he had a run in with a couple of Shock Jocks here in NJ. His wife was interviewed and she mentioned that she wanted to put her newborn baby in the microwave due to post-partem deppression. 'The Jersey Guys' or NJ 101.5 played that interview on the air and mocked it. The Govenor was very pissed and it almost came to blows. Otherwise he wouldn't have put his name anywhere near this situation. This is his way of making a case against radio personaities. I think the articles written about the incident are very clear about the extent to which the disclaimer and the rules were exposed to the players. That alone is more prevention than many other 'stunts'.

I mean, opie and anthony did nothing, they had disclaimers covering their ass, someone not hired by xm, a fan, unintentionally hurt someone, that's it. it wasn't attempted murder, it wasn't sex in a church. they had a contest and someone took it to far. would they arrest o and a if the asscunt with the airhorn stabbed the reporter. no, cuase the contest was to get the name out there, having the show's name the company and the channel, out over the broadcast. and more points if ya have a homemade sign. the airhorn guy took it to the next level and he should get burned if anything. 'nuff said.

What a fucking nothing this is.

When I worked construction, I routinely 'woke up' my fellow employees with an air-horn (as they did to me) and nobody every suffered any hearing loss. I'm not talking about a few feet away, either - I had one blast less than a foot away from my head, directly pointed at my ear. It rang for an hour or so, then everything was fine.

I hate to say it, but this seems like the same kinda shit hoo-hoo pulls with his "I've been suspended (but I'm really on vacation)" shit. The bbbboys were pretty hurt by the 'the first shock-jock on satellite radio' thing on whatever that show that was on monday or tuesday morning, so they're just trying to 'corrrrect' the news media and prove that they were truly the FIRST 'shock jocks' on satellite radio.
