SAN FRANCISCO (AP) - For the first time ever, a federal appeals court Wednesday declared the Pledge of Allegiance unconstitutional because of the words ``under God'' added by Congress in 1954.

The ruling, if allowed to stand, means schoolchildren can no longer recite the pledge, at least in the nine Western states covered by the court.

In a 2-1 decision, the 9th U.S. Circuit Court of Appeals said the phrase amounts to a government endorsement of religion in violation of the Constitution's Establishment Clause, which requires a separation of church and state.

``A profession that we are a nation `under God' is identical, for Establishment Clause purposes, to a profession that we are a nation `under Jesus,' a nation `under Vishnu,' a nation `under Zeus,' or a nation `under no god,' because none of these professions can be neutral with respect to religion,'' Judge Alfred T. Goodwin wrote for the three-judge panel.

The government had argued that the religious content of ``one nation under God'' is minimal.

But the appeals court said that an atheist or a holder of certain non-Judeo-Christian beliefs could see it as an endorsement of monotheism.

``We are certainly considering seeking further review in the matter,'' Justice Department lawyer Robert Loeb said.

The 9th Circuit covers Alaska, Arizona, California, Hawaii, Idaho, Montana, Nevada, Oregon and Washington state. Those are the only states directly affected by the ruling.

However, the ruling does not take effect for several months, to allow further appeals. The government can ask the court to reconsider, or take its case to the U.S. Supreme Court.

The case was brought by Michael A. Newdow, a Sacramento atheist who objected because his second-grade daughter was required to recite the pledge at the Elk Grove school district. A federal judge had dismissed his lawsuit.

``I'm an American citizen. I don't like my rights infringed upon by my government,'' he said in an interview. Newdow called the pledge a ``religious idea that certain people don't agree with.''

The appeals court said that when President Eisenhower signed the legislation inserting ``under God'' after the words ``one nation,'' he wrote that ``millions of our schoolchildren will daily proclaim in every city and town, every village and rural schoolhouse, the dedication of our nation and our people to the Almighty.''

The court noted that the U.S. Supreme Court has said students cannot hold religious invocations at graduations and cannot be compelled to recite the pledge. But when the pledge is recited in a classroom, a student who objects is confronted with an ``unacceptable choice between participating and protesting,'' the appeals court said.

``Although students cannot be forced to participate in recitation of the pledge, the school district is nonetheless conveying a message of state endorsement of a religious belief when it requires public school teachers to recite, and lead the recitation of, the current form of the pledge,'' the court said.

FUCK!! I almost shot my TV today. Jerry Falwell and Gloria Allred were discussing this. For once I agreed with Falwell. Somebody kill that bitch Allred! I want to skin her face and sew it on her ass so every time she takes a shit it'd look like she's smoking a cigar. Aaarrrgggh! :mad:

I was just thinking of something that happened locally on Long Island a week ago.

This Catholic school, Kellenberg Memorial, puts on a concert every year. So this year the chorus was siginging from Jesus Christ Superstar. This one girl, who will be a senior in the fall, wouldn't sing her lines from it because she felt it blasphemous (also she is a devout Presbyterian). She didn't want to sing "How can I love him (Jesus)". So she refused, and the school asked her not to come back to finish up her senior year, regardless of the fact that she is in the top 5% of her class.
They felt she was too controversial, etc.

I don't know who's right in this case.......but its still messed up

It was not like anyone would have noticed. Some schools are too liberal and others are too conservative. Most disrespect their students under the guise of teaching and safety.

I don't know who's right in this case.......but its still messed up

I don't like or agree with the schools decision to tell her to leave, but it's their decision. I am sick of this country and all the bullshit. We have too many rights! In some cases, like AIDS patients being exiled for having AIDS, it is understandable for them to sue their company or school. But, in cases like that girls, it's the schools decision, and I can appreciate it. She refused to do something the school asked, and she was punished for it. I don't want to hear this "It's against my religion" Horse shit! So, if you want to use that excuse, be prepared for the worst. That's the way it should be, you have to sacrifice something for your religion, it might as well be your freedom! <--I don't know if that made sense, but I felt good about it. :)

I know who is right in the Pledge of allegiance case! I am! America is right! This country was built on something, people believed in something, and the beliefs of our forefathers are being questioned now? This cannot be allowed to happen. The people who come to this country to get citizenship need to follow the same guidelines we have been following for the last 200 years. We need to make a stand and tell the people that if they want to live here, they have to respect the colors, pledges, and songs that represent us as Americans! That's final!

i agree with it its in the constittution that church and state r to be seperate. I think these people r even bigger patriots for trying to make the pledge of alegence better. This isn't 1950 we don't need to say stuff cause people tell us and i don't think anything u do should be done out of respect if u don't believe it why can't we change it too "a god" or take that part out it doesn't matter how long something had been going on if its wrong its wrong no two ways about it!
