If you think most non-fiction books are completely true you are sadly mistaken. Not to mention that most autobiographies have little to no input from the actual subject and are written completely by ghost writers. If you really follow literature, many writer's fictional novels are more autobiographical than most non-fiction books.

Also, from what I've read about it he wrote shit that was far more than embellishment. ie; A few hours in jail is a far cry from months and years. If it was fictional "based on a true story" I'd be fine with it but when I buy non-fiction I want non-fiction because I depend on the info to be accurate.

Exactly. It's not a "non-fiction" that matters. It's the life story of a person who you don't know anything about and who is of no importance. He may as well be a character in a novel, as before that book was written, he basically did not exist. If the guy decided to package an exaggerated version of his life as a memoir it really doesn't matter. The decision was probably made because as a story of fiction, it really wasn't that good. But your expectations for a "non-fiction" memoir and a fictional novel are different.
