As much as I hate Hoo Hoo, perhaps it's not the best idea to start bashing him from the get-go. The new listeners are gonna be his former ones, so I'd say it's best leave it alone until they get people hooked, then go for the jugular.

I have a more gooder idea, break the carts, then decorate the ceiling of the studio with the exposed tape, as well as the walls, the Quivers Memorial Dunking booth, and everywhere else, then take Than out of the booth, and fill it with all the tape from the carts, and invite Grandma into there to try to save it as we all laff and laff and laff and laff, maybe his wig will come off, too!

Exactly. They don't need to break "kayfabe" on this bit. Of course even if Stern really has backups. But even if they did have access to his material and they weren't allowed to touch it. They should say they're breaking rare 'the only copy' material anyway. Of coures if they're breaking tapes from 2000 and beyond no one would care. I think smashing supposedly rare tapes from the late 80s would be shocking. Maybe even play 10 seconds of a classic Stern bit and say that is the only copy and then destroy it.
Don't tear down the 31st wall.
Maybe they can have Stern fans plead to save a particular tape. Maybe a female fan can come into the studio and blow.... nevermind.

I'm pretty sure most people on here know this already. But the "Howie tapes" are not going to be the ones smashed. The material is owned by Howie and CBS, in that order, and this has to do nothing with the actual physical carts they were recorded on. That stuff was duplicated and is in cold storage on discs where Howie and CBS both have keys to.
The original dispute anyway was the performance rights over the material. Howie owns the material, but not the rights to perform any of it on any other outlet. So CBS owns the rights, Howie owns the material. To make it simple to understand, think of music you buy. You own the actual copy, to play til your hearts content, you aren't allowed to perform, broadcast, or market it.
Anything being busted up on the radio will just be the physical carts, which may or may not by now have anything Stern related on them. These physical carts were always CBS' property to begin with. So no, none of that would cause Howie to go ballistic, but I agree it would be a good radio gag.
