PHILADELPHIA - The battle for cheesesteak supremacy — usually fought with beef, onions and cheese — has moved out of the kitchen and into the courthouse.


Pat's King of Steaks, a South Philadelphia institution since the 1930s, is suing Rick's Steaks for trademark infringement.

The two eateries involved, located less than two miles apart, each are owned by a grandson of Pat Olivieri, purported inventor of Philly's favorite sandwich.

Scott Pollack, the lawyer for Pat's, said Wednesday that the businesses are not connected in any way — even if the owners are. Pat's owner Frank Olivieri never gave permission for cousin Rick Olivieri to use the trademarks in his advertising and signage, Pollack said.

"Obviously, Pat's Steaks is very, very famous. It's known all over the country and the world," said Pollack.

The lawsuit filed Monday by Pat's claims that Rick's has been illegally trading on Pat's name, its crown logo and trademarked phrases, including "Pat's King of Steaks Originators of the Steak Sandwich." It seeks unspecified damages and an order preventing Rick's from using the material.

Rick Olivieri said his lawyer has not yet reviewed the lawsuit.

Frank Olivieri only learned of the alleged trademark infringement over the summer, after Rick Olivieri appeared on NBC's "Today" show and after the opening of Rick's stand at Citizens Bank Park, the baseball stadium for the Philadelphia Phillies, Pollack said.

The Web sites for the two cheesesteak purveyors offer a similar history of the sandwich, though they differ on some details.

Essentially, they say that Pat Olivieri invented the cheesesteak in the early 1930s while operating a hot dog stand in South Philly. After making a sandwich for himself on the grill — meat and onions on an Italian roll — a passing cab driver got a whiff. The cabbie tried it, and a Philly favorite was born. Cheese was added later.

Agreed. FUCK both of them. Tony Luke's all the way. Heck, Steve's in the Northeast is better than Pat's. I never even heard of Rick's. And if I was down in South Philly, I'd go to Geno's simply because Joe Vento is a good egg.

Good call on the Tony Luke's, make a great steak. There's so many great mom and pop shops that make good steaks but stupid Pats and Genos are tourist attractions.

Agree with all. Tony Luke's kicks ass. Jim's on South Street is okay too. But as was said, any mom and pop or other pizza and steak shop is better than Pat's or Geno's.

I don't know if anyone ever had a Pudge's, but they're opening one not far from me. They do a decent steak sandwich.

I took a bunch up to the Traveling Virus show at the PNC center.

BB - Thanks for the link. None of those are anywhere near me. They're opening a Philly Soft Pretzel Factory (http://www.phillysoftpretzelfactory.com/locations.html) in Collegeville, which isn't far from me. I'm not too big on the pretzels though.

It's down by the end of US 476 ( the Blue Route ) by the Commodore Barry
Bridge. Takes about 45 minutes to get there from Blue Bell.
Maybe less at night when the traffic is light.

Well I dont get many chances to go up north very much so I really dont have time to go looking for great cheesesteaks but I know there are plenty around. So I go with the tried and true favorite. Believe me someone who lived in South Jersey and worked in Philly there are plenty. Heres a tip for anyone who wants to move to Florida...Learn how to make your favorite foods because you are not going to find them here. Case in point I asked for a cheesesteak once and got cold sliced roast beef with swiss cheese and raw onions with mayo .WTF! Needless to say the deli clerk almost ended up wearing the fucking thing. Dont even get me started on water ice, pretzels or scrapple down here. Sorry to get all Henry Hill but thats the deal.

Miss the soft pretzel place in the Pennsauken Mart in South Jersey. That place was so hispanic I kept expecting a chicken to go flapping in front of me with someone chasing it as I got my bowl screens and headed to the Pretzel place

You dont go to Tony Lukes for cheesesteaks you go there for the best Roast Pork w/ sharp, every time i cross the bridge i stop for a roast pork. They just opened one at the Borgota in AC, when you lose all your money everythings ok when you bite into that.

Amen brother...I moved to FL 5 years ago from the northeast and there is no such thing as a good cheesesteak, italian sub or chinese food for that matter. I did finally find a place outside of Orlando that serves New England style seafood though (whole belly fried clams).

It is true that almost any sandwich place or pizza shop I've ever been to here in the area can outdo the tourist stops down in South Philly.

I always liked Steve's Prince of Steaks in the Northeast and now they are opening one up this way, in Langhorne across from Reedman's.

Pat's is good for sopping up booze at 3am and can be amusing.
Never heard of Rick's.
Hopefully the Tony Luke's on Oregon is better than the one they opened in University City, because I ate there, it wasn't very good and I had to shit 20 min after I ate the steak.

Personal favorite for me is People's Pizza on 38 in Cherry Hill. Worth the 20 min or so each way to get(and they always have it ready in 10-15 min tops).
