I got a DWI Feb 6 07. Blew a .23(ouch). I went to court tonight for the fourth time, they dropped my aggravated (twice the limit) and gave me a strait DWI. I'm lookin' at three years probation and fines. I have no record at all. Is three years alot? anyone else have stories?

Most people that get their first DWI don't have records, either. Most likely at this point in time, if you get in trouble for DWI, it was likely you gave the cop a reason to pick you up and check you out.

I work for a pre-employment screening company (background checks, etc.) and we see this kind of thing all the time. The fact that you still have a license is good. 3 years probation is on the high end of normal, but understandable if it was bargained down from aggravated DWI.
As Sinn Fein mentioned, when your insurance rolls over and they pull your driving record, you can plan on a few years of very high rates.

Maybe you should thank god you didn't kill someone. Insurance and probation and all that shit is nothing compared to what could have happened. I know a guy who doesn't even remember getting in the car, and killed a woman crossing the street. He was a good guy and the court was pretty lenient considering. But he was never the same.

You get hit twice in Nj. The insurance 'surcharge' (seperate) is 1K for 3 years. I re registered my car in my ex's name after I got my lisence back so I'm not sure of the actual insurance... I remember being quoted at almost 4K for six months... or was it a year.. I can't remember.

My Uncle who is originally from the Valley Forge/Philly area was diving drunk in Hudson, Mass nearly in late July 2004 and he was swirving on 495 North and the State Police turned on their lights. He led them on a chase until he crashed into an enbankment on route 62. My aunt called our house early the next day in tears that her husband and father of three (two from a previous marriage) was in jail on a DWI for the second time in less than six months. My father and I had to go bail him out of jail. It was heatbreaking watching my aunt cry over this shit.
Well, he lost his license for a year, which was pretty leniant in a Commonwealth such as Massachusetts, but you just don't do that. The Ad Concil campaign "Buzzed Driving is Drunk Driving" which is aired on PSTV, WQKE and other stations across the country, is not intended to be cute. If I drink before I drive, I have no more than one beer at most. Otherwise, I let someone else drive. Which explains why I haven't been pulled over yet and why I won't get pulled over anytime soon.
Next time you guys think about getting behind the wheel and driving, think of the old Ad Council PSA's with the pictures and the home videos of the dead kids who were in accidents.

And a double lucky for me the two times I got stopped I had a badge and was able to get out of it.
Not that I believe in luck but I can't find another word to use.

If your going to drink, and we all know you are - know your limits. I've been known to drive with about six in me.. however, If I'm getting dumb, then I won't drive..
I hit a pregnant woman when I got nailed for DWI. I was sick & admitted to having 2 beers 6 hours earlier and got nailed as a result. I wasn't drunk, but I was drugged up enough & broke more than enough to get myself screwed. 6 mo suspension & fines + a week in their little rehab group.
Your going to drink. Just know your limits. Be responsible. Even if you only care about yourself. This is common sense folks.

Drinking and driving is irresponsible and stupid. Sometimes, it takes getting arrested to wake people up, but really it shouldn't.
I got a DUI back in '97 and these days, I won't drive if I've had more than 2 drinks. It's just not worth the risk to myself and others, let alone the legal ramifications.
To think you're just a "good drunk driver" is ridiculous. You're lucky and luck runs out.

I think Anthony had the best idea I have ever heard - the drunk driving license. This .08 shit is just that - nannified shit. I have driven hammered a lot of times and will probably drive hammered several more times before I die.
Hell my dad would drink a 12 pack on the way home from the job site every day of the week. People are becoming a bunch of pussies.

I'm lucky though, I have a lot of attorney friends and they had previously coached me on what to do to allow them to keep my dumb ass out of jail in case it ever happened, so my guy says there's a good chance he can plea it down to a PI, or even get it dropped.
I had gone 10 miles and was 1/4 mile from the house. I ignored a speed trap where it went from 55 to 35 for like 10 feet like I always do, and the cop told me I was lucky I didn't get some reckless endangerment bullshit for my excessive speed too. I was doing 56...
Designated traffic cops are second only to meter maids in terms of uselessness to society
Edit: In case you're wondering what my attorney told me... Never, ever, ever under any circumstances take the breathalyzer. Even if you're convinced you'll beat it. There's something about the manufacturers of the machines keeping their operations a secret, and there's no outside validation on the calibrations of the machines. So you could theoretically be stone sober and still blow a .08. Also, if they try to court order a blood test that shit takes awhile. While you're in your cell choke down as much water as possible. If you puke, that's fine. Just keep chugging. You'll dilute your system at least a little bit and it might be that little bit you need.
Stay as silent as possible. Stick to yes and no answers as much as possible, and only when you HAVE to answer. EVERYTHING is being recorded and videoed. Don't do field sobriety tests, and don't think you can talk your way out of it. If the cop gets you out of the car, chances are you're going to jail no matter what you say or do, so the best thing you can do is just turn around and put your hands behind your back and let someone who's passed the BAR handle it from there.

About 3 or 4 years ago, I got pulled over for passing a bus on the left, crossing the double line etc., it was a 1 lane road. It was about 3am and I had a few drinks, but I was fine, I know I was fine. He asked me.... and I told him I had a few earlier, but nothing since 11 o'clock. He asked me to take the breathalyzer while I was still in the drivers seat. I HAD to be somewhere the next day (Sunday) so I did it and prayed. Never took 1 before.
I exhaled, but sorta puckerd my lips so it looked like I was inhaling, and blew into the straw with 'fresh air'.( I know it doesn' t make sense) I had to try it again because I didn't blow hard enough the 1st time. He read it and says I'm "this close" to the limit, and let me go with a speeding ticket.
So if you really feel OK, it may be better to take the test.
I still drive with a few in me, but never anymore when I'm drinking all night. I always get a hotel at O&A events and stuff. I know when I can't drive or shouldn't chance it.
Never got a DUI or DWI, but I came close when I was younger. Drunk Driving was a sport back then, now its just impossible.

This could easily backfire on you... the delay could allow more time for the alcohol you'd drunk to be absorbed into your blood stream, resulting in a higher reading.
And chugging water will not remove alcohol from your blood... this is just more of the "Fool the piss test." stuff of myth and legend I used to hear when I was in the military... drinking pickle juice, golden seal, etc... hogwash.
The human liver detoxifys the body of alcohol at the rate of between 1/2 to 1 ounce an hour... period. Guzzle water by the gallon, run around the block, bark at the moon... makes no difference. Time is the only cure for drunk.

I've done a helluva lot worse and still have managed to concentrate. Just like the 48 hour benders I used to pull working (sober)

NJ has recently stopped using the breathalyzer and switched to the Alcotest
method. Another NJ boondoggle because it can't be adjusted to the new dst
time. meaning officers have to wait 1 hour before testing for it to be admissible
in court.

Main thing you have to do is make sure you don't get in trouble again in that 3 years. Probation violations are not good. You'll end up doing more time for a violation than an actual crime.

Another thing to watch for is not getting busted for driving with a DUI suspension. In most states it's mandatory jail time. 90 days each time in PA. The state prisons are full of guys who have 4 or 5 of these sentences running consecutive.

This is just what I was told by fuckers that are much smarter than me, and they're all in Texas, so digest accordingly.
And yes, Tax Kunts is right, I have a hearing in a month that only pertains to the fact that I refused a breathalizer, and technically I should have a mandatory 180 day license suspension, but in Texas it's almost automatic that you're given a provisional 9am - 9pm driving permit, so it doesn't truly hinder your life much. It might suck worse in Jersey, but that's what my lawyers here in Texas advised me to do, and it all seems to be working out.

I recently was at a meeting where my civic group is buying " drunk goggles " their called to distribute to local schools... they give you the affect of being drunk when worn. A policeman cam out and let us check them out.
These things fuck your perception up like crazy.... I have drank from a keg three days straight and never felt that fucked up... If this is what common people feel like when drinking jesus christ dont drive.

That's not true. In NJ you only have to pay your restoration fee to get your license back which is $150 on top of the $1000 per year for 3 years. My dad got picked up for a DWI recently. He's 3 months into a 7 month license suspension, he had about 500-600 in fines and then the surcharge for the insurance. He also had to go to a class to learn about how bad it is to drive drunk and all that stuff in Hackensack for 2 days. Just the other day he had to go see a therapist and now has to do group therapy for 16 weeks. It's good for him though since he's a bad alcoholic. His face looks like shit and he's starting to get bad nosebleeds. He went to AA after he got picked up by since he lost his license he's gone back. The whole front bumper came right off. It was kind of funny since he wasn't going to be driving it anyway. Now my sister is scared to drive. So I'm stuck with getting the groceries and picking up this and that and driving my dad to Home Depot if we need stuff and all those things. Memorial Day can't come soon enough for me because that is around when he's supposed to get his license back and I can finally get some sense of my life back.
The night in July when he got picked up by the cops was, so far, the worst night of my life. I became a parent to my own father. I was not prepared for it whatsoever. It fucking sucks ass. It gets me so mad when I see people who have been drinking heavily go and get behind a wheel. I ratted some guy out as I was coming out of a diner one night and I felt good doing it because he could've killed someone. So to everyone that gets behind a wheel after they've been drinking heavily, you have no idea what you're going to do to your family or those who care about you when u get that DWI and I don't feel sorry for you because you made that choice.

How would they prove you were driving impared if you are under the legal limit?
I would think that if they could write that ticket based on actions, then a majority of drivers in this state would be 'impared' somehow..
They can say they saw you driving irratically and bring you in on a DWI saying you were a danger to others. I don't think it would stick in court but they can make your night hell. I had to take a class all about it.
I forgot that most of the time you also have to pay to get your car out of the impound too.

My dad got picked up for a DWI recently. He's 3 months into a 7 month license suspension, he had about 500-600 in fines and then the surcharge for the insurance. He also had to go to a class to learn about how bad it is to drive drunk and all that stuff in Hackensack for 2 days. Just the other day he had to go see a therapist and now has to do group therapy for 16 weeks. It's good for him though since he's a bad alcoholic. His face looks like shit and he's starting to get bad nosebleeds. He went to AA after he got picked up by since he lost his license he's gone back. Consider you self lucky, my sister almost died to her fucking dunk ass boy friend rolled the car in to a telephone pole. And one of my ex employees lost his sister and uncle to a fucking drunk drivers one year to the day of each other.

A good friend of mine has gotten away with driving drunk for years. Hes what they call a functioning alcholic, had a bottle of jim beam to get him through the work day then a 12 of bud bottles to get him through the night. But about a year ago he was out driving drunk and hit a handfull of cars before flipping his car on its roof (a dodge neon SRT-4). Somehow he got away with it, he went to the hospital and his blood tests came back a .28! THe blood test never appeared in court and the case got thrown out. I told him that was his freebie and smarten the hell up. Sure enough two weeks ago an officer found him passed out in his car at a green light with cars going around him. long story short 6 month suspended liscence, 1 year probation, $1500 in fines, and DUI school. He always said he was a good drunk driver. Im just happy hes off the road for 6 months, he could have killed himself or someone else both times.

The thing is, some people never learn. I have a friend that had the breathalyzer thingy gizmo installed on his car, so you have to breathe and hum into it to get your car started. If you blow a positive, it locks you out for 24 hours. The fucker must've called me a dozen times claiming he only had "cough syrup", or there was something in the food he ate that sent off a false positive, and he was stranded and could I help him.

I was in the car with my ex, Matt, when he got his DWI... (I can't drive stick and suck at driving in general) He had one of every mixed drink the bar offered within a 3 hour period, then hopped in the car and made an illegal left turn. When the cop's lights came on, Matt drove over a curb. When the cop told him to step out of the car, he fell out sprawling on the asphalt. It went downhill from there...

Wasn't trying to sound like an expert guys, nor was I trying to give legal advice.
This is just what I was told by fuckers that are much smarter than me, and they're all in Texas, so digest accordingly.
And yes, Tax Kunts is right, I have a hearing in a month that only pertains to the fact that I refused a breathalizer, and technically I should have a mandatory 180 day license suspension, but in Texas it's almost automatic that you're given a provisional 9am - 9pm driving permit, so it doesn't truly hinder your life much. It might suck worse in Jersey, but that's what my lawyers here in Texas advised me to do, and it all seems to be working out.
If it makes you feel any better I have been given the same advice from a lawyer.

I refuse to get into mud slinging but there is no such thing as a "good" drunk driver. You may be able to keep it between the lines and go the speed limit, but reaction times are affected by alcohol. There is on way around this.
Stupid gimmicks like the alcohol goggles and the car with controls that act like you're drunk over simplify the effects alcohol has on your system. Everyone is affected differently, but make no mistake; everyone is affected in some way.

When im sober i daydream, look all over the place except the road. eat, talk on cell phones and generaly not pay attention.
Im not even trying to be funny.. Im more normal drunk.
As far as the karma comment.... its not luck as i said before... Its the fact im like any other driver. and Ive been pulled over with a beer between my legs... been tested. never arrested. atleast 30 times. Im sure someday some ass cop will bust me,,, because basicly three beers and you fail the breathalizer.. but Most cops see you are not a danger to anyone and let you go.
Just because some asshat drove fucked up.... dont label everyone that way.
theres a gigantic difference between drinking and driving and driving fucked up.
In my 20 years, no accidents, no tickets, not a scaratch on a vehicle. So just because you cant do it, dont call me an ass.

Nope, I went with him to the classes for moral support. The guy who taught them stood up and said in all seriousness, "K, When you leave here and go straight to a bar, here's how to get home without getting caught." He then proceeded to give the formula of how long alcohol shows up on a breathalizer test and how to space out drinks to get away with it. From there, we watched some bloody gore filled videos on the effects of drunk driving.

It's unlikely you can "beat the breathalyzer". There are various methods a person can use to impede the breathalyzer reading but none of them will yield a lower BAC result.
The most likely plan you're thinking of is the "breath quickly in through the nose and out through the mouth" crap. That will most likely result in an insufficient sample reading (NSF). Jurisdictions vary, but in PA if you blow an NSF the cop will write you down as a refusal which will result in an automatic license suspension, regardless of a conviction for the underlying DAI offense.
The only advice anybody should follow from jackasses on the internet regarding criminal law is to consult with a local attorney in your area for the specifics.
And never, ever confess anything to the cops. Nothing you say can possibly help you.

Well, I admit I wasn't present when you took these tests so I suppose it is entirely possible. Of course, I wouldn't be surprised if the person administering the tests fucked up. Although BAC tests are incredibly accurate the testors could often use more than 4 hours training.
