An off-duty detective who shot an armed thug to halt a brutal beating has become the first police officer to run afoul of new NYPD rules requiring cops to take Breathalyzer tests after firing their weapons, police sources said.

The 44-year-old detective from Brooklyn South Narcotics, a 15-year veteran of the force, was placed on modified duty and stripped of his weapon after the shooting at 2 a.m. Sunday, in which the thug opened fire first with a powerful Tec-9 automatic handgun, the sources said.

Stephon Allston, 22, a Queens man with a rap sheet, fired three shots but missed. The detective fired five times, hitting the suspect in the arm and leg. Allston fled but was later busted and charged with attempted murder.

Under rules adopted by the NYPD in October 2007 on the recommendation of Police Commissioner Ray Kelly, the detective was forced to take a Breathalyzer test - and failed it narrowly.

His blood-alcohol level was 0.10. The state limit is 0.08. For a man who weighs 160 pounds, that's six drinks in two hours.

Veteran officers said it was unlikely the detective would lose his job, but a senior police official said, "The jury is still out on this."

The rules, adopted after Sean Bell was killed in a hail of 50 police bullets on Nov. 25, 2006, are highly controversial in the department.

"Years ago, if you didn't take action, the department would accuse you of cowardice," a police source said. "Now they encourage you not to take action."

A veteran cop agreed: "Anybody who carries their gun off duty is an absolute idiot."

Mike Paladino, head of the Detectives Endowment Association, said the detective "did a heroic job, despite the results of any breath test."

So far, a dozen cops and six detectives have undergone Breathalyzer tests after firing their weapons, but the detective in Sunday's shooting is the first to be punished. A breath test is mandatory only if a cop hits someone.

Sean Sawyer, an off-duty narcotics cop who shot and killed a motorist in a Manhattan road-rage incident last year, disappeared for 19 hours after the shooting. Authorities suspect he did so to avoid a Breathalyzer test.

Sawyer was cleared by a grand jury last week.

In the shooting Sunday, the detective was with a seven people, including two off-duty correction officers who were waiting to enter a Queens club, when he saw four men walloping another, police sources said.

The detective and the others in his party went down the street to stop the beating. When they got there, Allston pulled out a Tec-9, jammed a magazine into it and cocked it, the sources said.

"I'm a police officer," the detective shouted, ordering Allston to drop his weapon.

Allston allegedly opened fire, fleeing when he was hit. He was arrested at Franklin Hospital in Valley Stream, LI, along with another suspect.

Now the mayor has come out and said he acted appropriately but its too late Mayor Bloomturd. The message has been sent. Help out off duty and you risk losing your job, pension, or the ability to feed your family. Keep teaching cops to hesitate. Keep teaching criminals that they can do whatever they want.

Wonder what is gonna happen when this cop gets teh civil suit? The city gonna back him up since he was taking police action? You gonna pay his tab to the creep that shot first mayor shithead?:icon_mad:

Not guilty of criminal charges. He will still face department charges for leaving the scene of the shooting and disappearing for 19 HOURS. He can, and should, loose his job. Buh bye job and pesion for him. No jail but no means to support his family either.

This is VERRRY different. He interrupted/stopped a crime(maybe kept the guy out of a coma/death), got shot at first, and stayed on the scene.

Yes. Undercovers are allowed to have 2 drinks (max) in order to blend in with their surroundings. This rule was thrown in by the commisioner to appease Fat Al and his friends. Reap what you sow asshats.

Personally I know I would never pull a weapon on someone EVEN if I was shitfaced drunk after drinking hard alcohol. But I know that if I were to be caught with a pistol and having drunk a couple of beers then I'd be arrested.

So, if I know that I'm going to have a couple of beers, even if out eating, then I will not carry my pistol on my person. I will leave it in the truck.

Why are these cops getting a pass to carry firearms while drinking? Did they learn some special drunk techniques in their government training academy that makes them more qualified than the average person to carry a firearm after drinking?

Your comments are misleading. No where do you mention that the entire point of the article, which was that the cop failed a breathalyzer test. Did you actually read it? I agree with what you are saying, though.

well that is what is going to happen now but i know for a fact that fbi people have to carry their weapon with them at all times. this may be the same for officers within the city they work for.

this fucking pisses me off. it started a while ago but yeah the criminals are slowly becoming the norm and we are becoming the criminals. yes doomed

Here in Ny cops ARE supposed to be carrying 24/7. But there are times where its not advisable to carry. The example they usually use is the beach. No place to store/safeguard it etc.


He wasn't unfit for duty, which a cop in NY must be 24/7. .09, which the blood test showed is .01 above the .08 needed to drive a car. Does it mean he was shitfaced? falling down drunk? Or as the NYPD deem it, unfit for duty?

And they got a warrant to take blood from him. Now, maybe a lawyer can help me out here, but I know you need a judge to sign a warrant where a crime was suspected. Taking police action stopping a crime and then RETURNING fire doesn't seem like a crime to me.

Believe me I read the whole thing. And I get the point of the article but the message I, and most cops, get from it is a different one that a civilian would. Basically it says that when you DO step in you will be looked at like a criminal first and a cop second. You will be stripped of your gun and badge and can't perform your normal cop duites. And thats for acting like you were trained to act doing what you were trained to do.

As a civilian we are not considered "always on duty" either.
