I (and probably most of you) am really sick of this stalled merger. I don't even care if it happens, I just want it done. With 2 votes for the merger and 1 vote against, the swing vote is now firmly on the shoulders of Republican Deborah Taylor Tate. Below you will find a link to send her an email. Whatever your feelings on the merger, send a message to make a decision already.

You'd have to spoof the mail so it comes from the NAB, and try to convince the FCC to believe they really don't want satellite radio destroyed any more. Be sure to thank them for the work over the past year and a half and apologize for asking them to go out of their way..

He called for a six-year price cap and pushed for the companies to make one-quarter of their satellite capacity available for public interest and minority programming.

So far, two of the five-member commission have voted to approve the deal. Adelstein's vote would give the satellite radio companies the majority that they need to become one.

Adelstein Nixes Satcaster Merger, Tate Deciding Vote



FCC Democratic commissioner JONATHAN ADELSTEIN has withdrawn his concession proposal for signing off on the XM-SIRIUS merger and has cast his vote against it, the AP reports. The vote now stands at 2 for and 2 against, with the deciding vote coming from Republican DEBORAH TATE.

Last week (NET NEWS, 7/17 (http://www.allaccess.com/site/netNews/story.php?bs=sk&ng=industryTools&ag=172&storyID=43165)), ADELSTEIN offered to vote for the merger should additional concession be made by the satcasters--devote more channels to minority and educational interests, a six-year subscription price freeze and inclusion of an HD receiver in future hardware. Apparently the offer was met with scant interest and even less support; consequently the offer was withdrawn and ADELSTEIN sided with fellow Democrat MICHAEL COPPS to vote no--which most observers expected anyway.

As predicted (http://www.allaccess.com/site/netNews/story.php?bs=sk&ng=industryTools&ag=172&storyID=42895), this leaves Republican DEBORAH TATE the deciding vote. Normally one who would side with fellow Republicans Chairman KEVIN MARTIN and Commissioner ROBERT MCDOWELL, TATE has been lobbied hard by both sides. According to public filings TATE wants to resolve pending enforcement action against the satcasters before casting her vote.

Good to know these politicians are just like the rest in their vote the party line predictability. So far all the Republicans are for it and the Democrats are against. The final vote is a Republican so it looks like it will just sneak by. Now if the old bag would just cast her vote we can put this shit behind us and get the boys a new contract.
