Rep. Perlmutter: Obamacare Real Hero in Aurora Tragedy

PERLMUTTER: Affordable Care Act is in place. The Supreme Court approved its terms a couple, three weeks ago. And it will do some things that, in my opinion needed to be done. It will stop the discrimination against people with prior illnesses or injuries, or say some of the folks who were shot in the theater, they would be uninsurable now that they’ve had that wound, but under the affordable care act they can’t be discriminated against starting in 2014.

Wasn't the ACA passed before the shooting? How are they exploiting the tragedy by pointing out the benefit of upcoming laws?

I really don't see how this is equivalent to Nancy Pelosi demanding that we ban all assault weapons the day after the Aurora shooting.
But aren't all illegal weapons used for assaulting someone?

Well, it's true. Assault is an action. That's like saying a gun is a murder weapon because it could be used to murder someone. I really hate the term "assault weapon" because it's something liberals came up with to create a reaction.

Actually, the gun itself still isn't illegal. It's like saying a kitchen knife is an illegal knife because someone was stabbed with it.

In the end, no guns are truly illegal in the US, even under state laws in places like CA and NY - SOMEONE can legally own them (Manufacturers, Title II dealers, LEOs, pre-ban weapons, etc), no matter how restricted they are.

However, the act of possessing certain firearms can be illegal, depending on the individual's history, or if that firearm has been modified in some way to make possession of it illegal by that person.

By making an emotional appeal instead of a rational one. An emotional appeal exploits the emotions raised by an event (in this case, the shooting), to cover up the irrationality of one's argument.

In this case, the irrationality lies in the double speak of calling something that we are mandated to buy, and providers are mandated to sell us no matter the circumstances, "insurance". Insurance is something you get ahead of a potential negative development, to mitigate its effects in some way. If you can get the same exact thing afterwards, then calling that thing "insurance" becomes Orwellian newspeak, and any argument it is used in is irrational (commits the logical fallacy of equivocation).
