Lehigh University student got a C+ and now seeks $1.3 million in lawsuit

A graduate of Lehigh University in Bethlehem, Pa. has sued the school for $1.3 million because she is unhappy that she got a C+ in a class in 2009.

Megan Thode, 27, says the grade ruined her dream of becoming a licensed professional counselor, reports The Morning Call, an Allentown-based newspaper. Her civil suit alleges breach of contract and sexual discrimination. It contends that the grade was part of a broader attempt to force her to abandon the graduate degree she was pursuing.

Trial proceedings began Monday in Northampton County and could last the rest of this week.

Thode was in the last year of a master’s in counseling and human services in Lehigh’s College of Education. She needed a B in the course at issue — a fieldwork class — to qualify for another round of field work, which was required to obtain the degree.

Thode’s lawyer, Richard J. Orloski, maintains that she deserved a higher grade. However, her professor, Amanda Carr, awarded her a big, fat zero for classroom participation. That zero brought her grade down.

Orloski has also alleged that Carr and Nicholas Ladany (who was the director of the degree program) conspired against Thode because she and three other students were critical when they were had to search for supplemental internships midway through a semester.

The suit also charges that the course professor treated Thode unfairly because of Thode’s support for gay and lesbian causes — a claim Lehigh flatly disputes, according to The Morning Call.

Thode did graduate from Lehigh with a master’s degree, but not the one she aspired to have. According to Orloski, the $1.3 million Thode seeks in damages represents the money she’ll lose over the course of her career because she isn’t able to be a state-certified counselor.

“She’s literally lost a career,” said Orloski, according to The Morning Call.

Neil Hamburg, an attorney for Lehigh, says Thode’s lawsuit is outrageous.

“I think if your honor changed the grade, you’d be the first court in the history of jurisprudence to change an academic grade,” Hamburg told the judge presiding over the case. “She has to get through the program. She has to meet the academic standards.”

Hamburg pointed out that Thode is the daughter of Lehigh finance professor Stephen Thode. One of the perks of that relationship was that she was able to enroll in the Lehigh graduate program tuition-free. The school provided her with a job as well. She also got to attend York College of Pennsylvania at no charge as an undergraduate thanks to her Lehigh connections, says The Call.

Thode was on the witness stand Monday. Another Lehigh attorney, Michael Sacks, grilled her about her free ride.

“Even after you sued Lehigh, you were getting free tuition and working for Lehigh?” Sacks queried.

“Yes,” Thode answered.

Lehigh’s lawyers allege that Thode’s behavior in class was not acceptable for someone seeking a master’s degree in counseling. On at least one occasion, they said, she used profanity in class. Another time, she broke down crying.

Before filing her lawsuit, Thode filed complaints with the university over the C+ grade, showing up at meetings with her father, the finance professor. She sought a written apology from Carr, the course instructor, and a “plan for compensating me financially,” notes The Morning Call.

Something doesnt seem right with this besides the obvious she is an ass. How does non participation in class pull down a grade a full point and a half? Most of the classes I took it accounted for maybe 10% but you knew exactly what that percentage was. If this dumb bitch knew what she says she knows about the professor than she should have been participating above and beyond to make sure she got a decent score. There is no way if you participate in a productive manner that she would have gotten a zero especially with the ability to video everything.

I coach bball with a professor at Lehigh and a head coach of a sport there, I will ask for their take. Plus if they happen to know daddy and what he is like.

It was a fieldwork class, so obviously class participation accounts for significantly more of the grade.

aahhhh the master's degree in social work. That's a HUGE money maker. lulz. I have a buddy who's wife does it, and makes decent money, but she's also like the director of her dept or something.

I dated a girl back in 2002ish that was getting her masters. She was over at the house and saw one of my paystubs sitting on the table. Oh the OUTRAGE she had when she saw how much an "uneducated" person was making. The whining was unbearable. "i'm going to have 100K in student loans and will only be making like 40K a year!" Umm... how is that my fault? I guess you need to make a better career choice and not waste your money on stupid degrees that you'll never be able to pay back the loans on.

If a C+ costs you a career, then maybe it wasn't your career to begin with. But Lehigh fucked up having him as their attorney



Also, if there's something I've learned in my travels through life, it's that college degrees mean shit. Many of the better people I know never even graduated college, and talent can't be learned.

Didn't your military training contribute to your current occupation?

It's unfortunate you didn't have to make real sacrifices like going to class 12 hours a week, partying Thursday - Sunday, and racking up debt the federal government only half expects you to pay back.


I ended up going back to school... it cost me another $50k, but there is a massive probability that my degree will earn me at least double that in additional lifetime income (and probably much more) so it's worth it. However I didn't start getting that great paycheck the minute I graduated, like some entitled people think happens. You still have to work your ass off to get ahead, and many people who took other routes (the military, a skilled trade) will and should be earning more money than me, especially as a recent graduate.

By the way, genius move "accidentally" leaving your pay stub out. :action-sm

College degrees are almost too easy to earn these days, and going to college is an extension of childhood now. People get out after 5-6 years with a Bachelors having never worked a day in their lives, and expect life to be easy. If anything, your life will be harder after graduating college (compared to never going). You may not have all the fancy toys/vacations if you spend your life framing houses, but you can earn a good living and the job is over when you punch out.

The best teacher in life is experience.

I remember a few years ago studies were showing that younger people were taking a lot of jobs right out of college that much more qualified older people, 40's+, had or were applying for because these graduates had degrees while the experienced older people didin't.

Now it is pretty much the exact opposite because this generation of college graduates have no concept of hard work and think they deserve $100k because they have a piece of paper.

Fuck this entitled generation of cunts.... So much anger towards these fuckos...

She should of been outraged. How DARE an employer consider military training count as any type of experience or knowledge of the procedures necessary to complete the tasks at hand of the job youre applying for. Especially when she sacrificed so much of her life by only having to take only 12-16hrs a week of classes to be considered a full time student to get full financial aide while not having to hold down a job to pay any bills or have any other responsibilities what so ever. How dare you sir you should be ashamed of yourself for learning a trade while serving your country to defend her right to not have to work while in college only to earn a degree that wont get her the same paycheck as you because employers value on the job experience more then a piece of paper she earned while taking loads in her free time and thencompensate the people with real world experience more money than those that never held a job in their life

I had a professor in college tell us one day that he was once sued by a student for giving her an A instead of an A+. The school didn't give anything higher than an A, but she claimed that she deserved the nonexistant A+ because she got over 100 on every exam thanks to extra credit questions. Her suit was thrown out.

Same here I dated a high-school teacher. I'd make a week what she made a month and I was just a bouncer and bartender.

At the time, I was working in the smei-conductor industry. I spent my days in an Intel clean room in a fucking gore-tex suit sweating my balls off. Like tattered mentioned, I got my education from the military. When she was sitting in college, I was working in a mobile nuclear power plant in the Persian Gulf.

As is the norm, she saw the fruits of my labor and felt it was unfair, but she'd never go through the labor that I did to get to the same point. It's easier to bitch about how much someone has AFTER they've busted their ass to get to that point

oh, it absolutely contributed. I learned how to fix shit and "get the job done" at any cost. I'd say that 50-75% of the guys I have worked with since I got out are all fellow vets.
