    this "supposedly" happened in DC recently and from what I understand the US Attorneys Office was not happy.

    Christmas time for everyone convicted. Records expunged, fines refunded, and probably a settlement out of the deal.

    I can't see how there is any possible way to avoid that. Convicting someone solely on a known faulty device. There should be criminal charges brought against anyone who knew about the problem also.

    In a perfect world, I'd agree 100%. However, our criminal justice system is a corrupt business. Some convictions will get overturned, but I'd be willing to bet 99% of the people convicted will never see a cent or have their records expunged over this. And something like 99.99% won't get their fine money back. When was the last time government GAVE BACK anything they took by force?

    You're right, the only way people are going to see compensation and justice is if they first appeal the conviction (and many probably pleaded no contest for a reduced sentence) and then sue the DA.
