The problem with not settling is that if it were to go to any type of trial, any "liability payout cap" gets tossed into the trash, and, a civil trial jury does not need to be unanimous, so, it's easier to just cut a "shut the fuck up check" than face a hundreds of millions of dollars judgement.
So while in essence I agree 100%, the family deserves nothing, it's better to settle.
Also, 75k is probably less than the lawyers would get paid to win a case in court.

My wife has a firm on a 250k monthly retainer, that's just one of several.

City of Ferguson pays out big money to settle Michael Brown wrongful death suit

The city attorney for Ferguson, Missouri, has disclosed the settlement amount in the wrongful death lawsuit filed by the family of Michael Brown.

Attorney Apollo Carey told The Associated Press Friday that the city’s insurance company paid the family $1.5 million to settle the lawsuit. The settlement was first announced Tuesday, but figures of the settlement had not initially been disclosed.

The 18-year-old Brown, who was black, was fatally shot in August 2014 by white Ferguson police officer Darren Wilson. Though Brown was unarmed, credible witnesses during the grand jury trial said 6-foot-5, 289 pound Brown charged Officer Wilson, who fired 12 shots at Brown, critically wounding him several times.

The incident sparked protests in Ferguson, which increased tensions between the black community and the police, and quickly transpired into violent riots and looting, leading Ferguson police to resort to armored vehicles and military weapons.

Wilson was cleared of any wrongdoing by the grand jury, but resigned in November 2014 shortly after the decision was made not to indict him. The Obama Department of Justice also concluded that Brown’s civil rights were not violated by Wilson in a report that cast serious doubts on the “hands up, don’t shoot” narrative.

However, the Department also concluded that racial bias existed within the Ferguson police department in a separate report, and the city of Ferguson agreed to make changes to address racial bias in its police department and local court system.

Brown’s parents, Michael Brown Sr. and Lezley McSpadden, filed the lawsuit in 2015 against the city of Ferguson, the former Police Chief Tom Jackson, and Officer Wilson, claiming the police culture in the city contributed to their son’s death, and that Wilson used excessive force during the incident. All defendants denied the allegations.

Federal District Judge E. Richard Webber approved the settlement, stating that it was “fair and reasonable compensation for this wrongful death claim and is in the best interests of each Plaintiff,” instructing that the money was to be split between the the sperm donor and sperm receptacle.

How was the death wrongful when physical evidence proved it was a justified shooting?
They "won" their settlement not due to that... it was due to the cops being mean to her indigenous people who were committing all the crimes. As while patrolling high crime (aka bleck) areas they cops would pull over more blecks. Which is rayciss... also rayciss that the cops pull over blecks more just because they make up 2/3's of the population...

Judges on the federal appeals court here on Wednesday had tough questions for both sides in a civil suit stemming from the 2014 fatal shooting of Michael Brown.

At issue is a federal judge’s refusal to dismiss a lawsuit filed by Brown’s friend Dorian Johnson against Ferguson, former police Chief Tom Jackson and former Officer Darren Wilson, who shot Brown.

But the issues are unusual and complex, and lawyers on both sides said the case presented a unique set of circumstances.

Johnson’s attorneys claim he was stopped by Wilson in violation of the Constitution. They say Wilson then used excessive force when he fatally shot Brown and shot at Johnson and missed. The suit also claims that Wilson’s actions were part of a pattern of misconduct by Ferguson police.

The Ferguson defendants denied that and have argued that the police are immune from the suit because their actions were not unreasonable. They also say that Johnson was never “seized” for legal purposes. He never submitted to Wilson’s authority, as he stopped briefly but then ran away.

If Johnson was not “seized,” then the constitutional questions don’t come into play, and even Johnson’s attorneys admit his lawsuit must then fail.

In March 2016, U.S. District Judge Audrey Fleissig sided with Johnson’s attorneys and refused to dismiss the case.

Two of three judges on a panel of the 8th U.S. Court of Appeals agreed in July 2017, saying Johnson’s allegations were sufficient to allow the case to proceed.

Wilson meant to stop Brown and Johnson, and the pair did stop, they wrote.

But Judge Roger L. Wollman dissented, saying that Johnson wasn’t really seized — that he had the option of leaving or moving to the sidewalk. Wollman said he would have instructed Fleissig to dismiss the lawsuit.

In an unusual move, the Ferguson defendants’ court request for a rehearing in front of the whole appeals court was granted.

They also allowed the National Police Association to file a brief in support of Ferguson’s position that Johnson was not seized. Lawyers for the association said that Fourth Amendment issues in the cases, and their consequences for police officers’ ability to know how to do their jobs were “of the utmost importance.”



On Wednesday morning, the judges focused on whether Johnson was seized and whether Wilson used excessive force.

Lawyer Robert Plunkert, who argued first for Ferguson, said there was no seizure of Johnson, as he could have left the street and gone to the sidewalk, as directed, or run away. He also never submitted to Wilson’s authority, Plunkert said.

Johnson attorney James. M. Williams urged the judges to focus on the “totality of the circumstances,” saying Johnson was first seized when his path was blocked by Wilson’s vehicle, but also throughout the encounter.

A skeptical Judge Raymond W. Gruender said that Johnson was never touched and never submitted to Wilson before running away, adding, a “temporary pause is not enough.”

Judge Bobby E. Shepherd asked Williams, if the stop was reasonable, “doesn’t your claim evaporate?”

Williams responded that the stop wouldn’t be constitutional if it was part of a pattern or practice to “terrorize” the black community, as Johnson, who was present in the courtroom, nodded.

Judge James B. Loken mentioned cases that found shooting at someone, and missing, did not represent excessive force.

The judges also asked whether they should consider two Justice Department reports – one that said the police department targeted African-Americans and the court system was used like an ATM and another that found that Wilson did not violate Brown’s rights. It also said some of Johnson’s claims about the shooting lacked credibility.

At the end of the hearing, Chief Judge Lavenski Smith said the case would be taken “under advisement.”

A decision is likely to take months.

Dorian Johnson, 22, was arrested by police in Jefferson City, Missouri, in June 2011 after he allegedly stole a delivery package off a doorstep in an apartment complex. He was attending college at Lincoln University in the city, which is about 120miles west of Ferguson.

When cops asked Johnson for his name, he told them he was Derrick Johnson and that he was 16 - though he gave officer a birth date that would have made him 17, according to an arrest report obtained by MailOnline.

Officers later found a student ID in Johnson's sock that gave his real name.

He was charged with misdemeanor theft and filing a false police report. He pleaded guilty to the latter charge. When he didn't show up to court to answer the theft charge, a judge issued a warrant for his arrest.

In reviewing the motion to dismiss, the Court must accept Plaintiff's allegations as true and construe them in Plaintiff's favor. The facts, as alleged in the complaint, are as follows. On August 9, 2014, at approximately 12:00 noon, Plaintiff and Michael Brown, Jr., both African-American males, were "peacefully and lawfully walking down Canfield Drive in Ferguson, Missouri." A marked police vehicle driven by Wilson stopped next to Plaintiff and Brown, and Wilson ordered the pair to "Get the f*ck on the sidewalk." Wilson continued to drive his vehicle several yards, put it into reverse, and parked it at an angle to block the path of Plaintiff and Brown, stopping the vehicle within inches of Brown. The complaint alleges that Wilson forcefully opened his door which struck Brown, and then reached through his open window and grabbed Brown who was closer to Wilson than was Plaintiff. Wilson threatened to shoot his weapon. As Brown struggled to break free, Wilson discharged his weapon twice, striking Brown in the arm. Fearing for his life, Plaintiff ran away from Wilson "simultaneously with Brown." Wilson did not order Plaintiff or Brown to stop or freeze, but withdrew his weapon and fired "at Plaintiff [and Brown]" as they fled, striking Brown several more times (and killing him). Plaintiff alleges that these events caused him to suffer "psychological injury, severe emotional distress, medical expenses, lost wages . . . and other loses to be proven at trial." - Hey don't you have to have a job to actually loose wages? Easy to explain. The black is a better criminal to begin with because he's been bred to be that way, because of his high thighs and big thighs that goes up into his back, and they can jump higher and run faster because of their bigger thighs and he's bred to be the better criminal because this goes back all the way to the Civil War when during the slave trade, the slave owner would breed his big black to his big woman so that he could have a big black kid.
