This happens every election year, going back to Reagan misinterpreting "Born in the USA" as an inspirational patriotic song. It always ends the same way - the candidate publicly says he has the right to use the song, but quietly stops using it.

Usually the record company who actually owns the copyright has no problem with politicians using their works - probably see it as a way of greasing the wheel or paying protection money.

Besides nobody has listened to Eye of the Tiger since Rocky III anyway (yea I know it was on the Rock Band II soundtrack) so I'm guessing that Gingrich's use of the song has generated more iTunes downloads for Eye of the Tiger in the last 3 months than there have been in all of the last 10 years.
