SELMER, Tenn. (AP) — The woman convicted of manslaughter in the shotgun slaying of her minister husband was freed Tuesday after serving 67 days in custody.
Mary Winkler was released from a mental health facility where she had been undergoing treatment for about two months, defense attorney Steve Farese Sr. said. He has declined to identify the facility where Winkler was held.

Winkler, 33, was convicted of voluntary manslaughter in the 2006 shotgun slaying of her husband, Matthew, at the Church of Christ parsonage in Selmer, where the couple lived with their three young daughters.

She was charged with first-degree murder, but jurors convicted her of the lesser charge after she testified that her husband abused her and demanded sex she considered unnatural.

Winkler was sentenced June 8 to three years in prison but had to serve only 67 days — 12 in jail and the rest in the mental health facility — because of credit for time in jail before her trial, the nature of the offense and lack of a criminal record. The remainder of her term will be spent on probation.

Farese said Winkler was headed to McMinnville, about 65 miles southeast of Nashville, where she lived and worked at a dry cleaning shop for eight months while she was free on bail and awaiting trial.

"She'll go back to work soon," Farese said.

A day after her husband's body was found, Winkler was arrested 340 miles away on the Alabama coast, driving the family minivan with her three young daughters inside.

Since her arrest, her children have lived with their paternal grandparents, Dan and Diane Winkler. Farese's law firm is helping her try to regain custody of the children

That was her testimony during the trial. She claimed that he wanted her to wear a wig and wear high heel shoes. She had the shoes on the witness stand with her as she testified. They were your basic stripper high heels. She said that was unnatural and that was her claim of being abused since she also testified he never touched her.

Wait, a woman goes to jail for three years because she bought alcohol for her kids party (yeah, I know the endangering the welfare of a child but she was saying instead of them going out and getting it themselves, she could monitor them at least) in which nobody was hurt but this cunt kills someone and gets two months? Where is the proof of abuse, by the way?

There is more to the story. She was abused. The unnatural sex was just a minor problem they had. This piece of shit guy was hitting a woman. Any time a man has to hit a weaker person to show how strong he is should be shot in the back. In this case the jury was wrong to even put her in a mental hospital. She should have walked away with an atta girl. Anyone who grew up in a family where the father or wife abused the spouse would say this girl did a good thing.

Source please. Because her testimony at trial was he never touched her. Her own daughter said she never saw any trouble. The neighbors claimed they never saw any evidence of a problem and she put the family in bankruptcy because she fell for that Nigerian email scheme. So where are you getting your facts from?

Just wondering because you seem so angry. Were you there living with them the whole time. I wasn't. I'm just going by the evidence at trial. Where is your info coming from.

According to CourtTV's Crime Library - she got tired of his constantly criticizing her. Verbal abuse is pretty bad...I think it's actually worse than physical abuse. The bruises & stuff heal, but verbal pretty much breaks the spirit.

I was too much of a coward to do it myself so I used to fantasize about my ex dying from a crack/cocaine overdose or from cheating a dealer in East New York or just getting busted and dying from the AIDS after Bubba made him his love bitch in Rikers or wherever they'd send him after Rikers.

Criticizing and verbal abuse are two different things. For all we know, the so called verbal abuse was him complaining that she let herself go and didn't care how she looked anymore. (Look at the picture) How many woman after they get married, cut their hair short, gain 50 pounds and don't give a dam about anything. Either way, she should have rotted in prison. Nothing justifies getting a shotgun blast to the back as you sleep.

I married my wife 19 years ago and she had long hair. I told her the day she cuts it, we are through. If I wanted someone with short hair, I would have married one. And by the way, it works both ways. If I suddenly gain 100 pounds, she should leave me because that's not what she married.

She admitted, according to the crimelibrary.com article that "her husband criticized her for "the way I walk, what I eat, everything. It was just building up to this point. I was just tired of it. I guess I just got to a point and snapped." Depending on what was said and how it was said and how often it was said, the criticism very well could cross that very fine line into abuse.

I agree with you that verbal abuse can be more damaging than physical abuse, but everything I 've read on this case lacks anything to justify what she did. As such why is she out of jail after 67 days. If a guy did this to his wife, he would have gotten life.

And I do hope that things are better for you now. Noone deserves to be treated in any manner other than full respect. I do family law and see abuse everyday. Nothing justifies it. If you are not happy, just leave. No need to berate someone.

This happened right down the road from where I live. I went to college with the husband's younger brother and was very good friends with him. They showed the trial on tv down here and I was able to watch most of it.

She did, indeed, fall for the Nigerian money scam and basically lost all the money they had. Her defense was that he was verbally abusive to her for many years (especially after the money was lost) and was into making her do "strange" things in the bedroom. She testified that, in addition to the stripper heels and costumes, he used to try to get her to act out scenes from porn. She also testified that she has no memory of pulling the trigger. She remembers getting the gun down off the closet shelf, but can't remember shooting him.

Her lawyers were so much better than the DA, it was laughable. They realized the best way to get her off was to basically put the husband on trial for being a prick. They painted a picture of some kind of sadistic freak who was into all sorts of "unnatural" acts. It's easy to make those kinds of claims when the other person is dead.

I did say that I didn't agree with the sentence and yes, you're absolutely right oh wize one - had she been a he, the book would've been thrown at him. It's one of the problems with our legal system.

Thanks for expressing some concern. Yes, it's been 12 years and I've never been happier. Life aint' always beautiful but what a beautiful ride. :)

Again this shows the problems with our legal system...in cases of ****, the alleged victim's lifestyle is not allowed to be put on trial. Yet, here we have a woman murdering her allegedly abusive husband, and instead of being the victim, he becomes the accused.

I may be a woman but I definitely do not subscribe to the 'women are always right' train of though. I guess 18 years working in the court system and 5 in private practice before that have taught me to always look in the middle of the two sides because that's usually where the truth lies.
