A US teenager has gone on trial in California accused of shooting dead a classmate because he was homosexual.

Brandon McInerney smuggled a handgun into a school near Los Angeles in February 2008 and shot 15-year-old Larry King twice from behind as he sat at a computer, prosecutors say.

They say the defendant, who was 14 at the time, was influenced by Nazi ideology.

He has pleaded not guilty to murder and to committing a hate crime.

The lawyer for the accused boy, now 17, does not deny his client pulled the trigger, but says he did it "out of heat of passion".

Defence lawyer Scott Wippert says his client had reached an emotional breaking point over unwanted sexual advances by the victim.

But the prosecution says the killing at EO Green Junior High School in Oxnard was inspired by white supremacist beliefs.

"The evidence in this case will prove to you that this killing was an execution," Ventura County Deputy District Attorney Maeve Fox told the jury.

After many delays, the case was moved to Los Angeles County for trial.

The defendant is being tried as an adult, and faces a life sentence if he is found guilty.

Mistrial clouds fate of teen accused in slaying of gay student

A judge declared a mistrial after jurors said they could not agree whether to convict Brandon McInerney, the middle school student who shot and killed a gay classmate during a morning computer lab.

Jurors deadlocked 7 to 5 in favor of voluntary manslaughter in the emotional two-month trial in the case of the stunning 2008 shooting inside an Oxnard classroom.

Defense attorney Scott Wippert said McInerney was disappointed by the mistrial because his fate was left hanging. Prosecutors probably won't announce until next month whether they will try the 17-year-old a second time, and whether he again will be tried as an adult.

McInerney sat stiffly and silently at the defense table as Ventura County Judge Charles Campbell declared a mistrial. His mother, Kendra McInerney, sobbed into her hands. The parents of victim Larry King, Greg and Dawn King, stormed from the courtroom with other relatives, even as the judge was still addressing the jurors.

McInerney was 14 when he walked into a morning computer lab at E.O. Green Junior High School, pulled a .22-caliber handgun from his backpack, put the gun to King's head and pulled the trigger twice. King was 15.

But jurors universally rejected the prosecution's contention that the shooting was a hate crime carried out by a youth filled with white supremacist beliefs and a hatred for homosexuals, Wippert said. He said jurors told him that it had been an emotionally raw and gut-wrenching case and that, in the end, they couldn't agree on a conviction.

Prosecutors declined to comment, as did jurors.

"He made this horrible decision at such a young age," Robyn Bramson, another defense attorney, said outside the courthouse. "He's going to be locked up for a very, very long time, and I want him to have a date on the calendar when he can get out."

How the fuck does this end up as a mistrial! Why because he was 14? I remember fourteen pretty clearly and I remember knowing exactly what I was doing at that age and why. He knew what he was doing, lock his ass away for life.

It sounds like they couldn't agree on the "hate crime" portion of the charges... and again I say fuck "hate crimes" and fuck the entire premise behind them. Convict the little fucker for the action he took, which was murder. Stop trying to prove what a person was thinking before taking those actions, that just confuses the situation and makes the case easier to derail. If they had left "hate crime" out of it, the kid would probably at least be in jail for manslaughter.

Teen gets 21 years in prison for killing gay classmate

A teenager who fatally shot a gay classmate in the back of the head at an Oxnard middle school was sentenced Monday to 21 years in prison.

A Ventura County judge issued the sentence a month after Brandon McInerney agreed to plead guilty to second-degree murder and voluntary manslaughter in the death of classmate Larry King.

McInerney was shackled during the sentencing and handcuffed as he was led from the courtroom.

McInerney, who was 14 when he pulled a gun out of his backpack and shot King two times at point-blank range, will be kept behind bars until he is 39 under the terms of the deal struck by Ventura County prosecutors.

In an unusual arrangement, the 17-year-old pleaded guilty to the charges after the judge declared a mistrial in his first trial. In return, prosecutors agreed not to go forward with a second trial, which could have resulted in a life sentence.

McInerney's first trial ended in a hung jury in early September, with jurors torn between murder and manslaughter. Some jurors said they believed the district attorney's office was being overly harsh in trying McInerney as an adult and several showed up Monday wearing "Save Brandon" bracelets.

McInerney shot King in a school computer lab at E.O. Green Junior High in Oxnard in February 2008, after days of conflict between the boys. Students and teachers at the trial testified that King had been dressing in women's accessories and wearing makeup, and was flirting aggressively with male students on campus who did not want the attention.

School administrators sent a memo advising teachers to give King his space, but to report safety problems.

Teachers at the trial testified that when they tried to report growing tensions between King and several boys, school leaders shunned them.
