Convicted killer who says death was accident to be executed

HUNTSVILLE, Texas - Lawyers trying to keep a Texas inmate from execution for a slaying the man claims was accidental have filed multiple appeals to the U.S. Supreme Court.

Richard Masterson's lethal injection Wednesday evening would be the first this year in the nation's busiest death penalty state.


The 43-year-old Masterson was sentenced to death for the January 2001 strangulation of 35-year-old Darin Shane Honeycutt, a female impersonator he'd met at a bar. Masterson testified at his Houston trial the death was the result of an accidental asphyxiation during sex and not an intentional murder.

Evidence showed he stole Honeycutt's car and was arrested more than a week later after stealing another car from a man who survived a similar sex episode in which he said he was choked by Masterson.

Man set to die for officer's death

HOUSTON- No late appeals are expected for a man set to be executed for a Texas game warden's death during a 2007 shootout.

James Freeman's lethal injection would be the second in as many weeks if carried out Wednesday in the nation's busiest death penalty state.

The U.S. Supreme Court earlier this month refused to review Freeman's case. On Monday, the Texas Board of Pardons and Paroles declined a clemency petition for Freeman.

Freeman was suspected of illegally hunting at night from his truck when a Texas game warden spotted him. Freeman led authorities on a 90-minute chase that ended with a shootout in which another game warden who joined the pursuit was killed.

Justin Hurst was fatally wounded after Freeman stepped out of his disabled pickup and shot at officers.

LEAGUE CITY, Texas - A suspect was shot and killed during a failed robbery attempt in the drive-thru of a McDonald's Saturday afternoon, according to police.

Around 2 p.m. the male suspect approached a man and his young child in the drive-thru of the fast food restaurant located at 102 South State Highway 3.

League City police say the suspect held the man at gunpoint and was attempting to rob him.

During the altercation, the driver shot the suspect multiple times, hitting him in the chest.

The suspect was transported to Clear Lake Regional Medical Center where he was later pronounced deceased.

Multiple witnesses confirmed to police the details of the alleged robbery however, officers say the investigation is ongoing at this time and will be referred to a grand jury.

Police said the driver involved is licensed to carry a handgun and has been fully cooperative with the investigation.

The name of the deceased is not being released at this time.

The best part is the guy had Texas Law Shield. He gave a very brief statement to the responding officers about "this man tried to rob me" and made a phone call to a cell phone on a card that we carry. Lawyer shows up at the scent shortly and handles everything. Already had a media statement crafted today. Dude went home with his son. Lawyer taking care of the rest.

If you carry, shit like US Carry or US Law Shield is so worth it.

We do live in a very pro 2a area and the cops don't give anyone shit, but better safe than sorry. This happens in NY, dude is assumed to be charged with murder and let the court straighten it out. Here in Texas, he was home having dinner....

The local news never follows up on the criminal history or race of the deceased persons. It does not fit their narrative. White man in his car kills black man trying to rob him. This is a mixed area, but I"m pretty sure the dead person is not white. High-spanic or bleek would be my guess. League City is a pretty white area on the south side, lots of NASA people.

A homeowner shot and killed an alleged thief who tried to either break in to or steal his pickup truck (KTRK)

HOUSTON (KTRK) --
A homeowner shot and killed an alleged would-be thief this morning in northwest Harris County.

It happened in the drive way of a home in the 12000 block of Oak Park Drive and Long Oak Drive.

Harris County detectives say the homeowner shot and killed the suspect who may have been breaking into a pickup truck.

The suspect died in an ambulance after being picked up by paramedics.

Deputies say around 4:30am the homeowner opened fire on the suspect.

Eyewitness News watched as Harris County Deputies took a hunting rifle with a scope out of the home and into evidence.

Authorities also towed away a blue pick up truck that was parked down the street. Deputies say that truck belonged to the suspect.

Authorities were out all morning, but did not give many details about what happened here.

Those who live nearby say this is usually a very quiet subdivision.

Resident Michelle Masters said, "Never anything in this neighborhood, It's quiet and nice. I'm staying with my mom right now and she has lived here for over 14 years and she has never had any problems here."

As for the homeowner, we do not know if the case will be referred to a grand jury, but we can tell you the man left with his family and was not in custody.

FORT BEND COUNTY (KTRK) -- A homeowner shot and killed a man trying to rob him Wednesday night at his home in Fort Bend County.

Fort Bend County Sheriff Troy Nehls tells Eyewitness News the would-be robber demanded money from the homeowner as he pulled into his driveway in the 18300 block of Mossy Creek. That's in the Mission Sierra subdivision near Richmond.

Instead, the homeowner grabbed a gun from his vehicle and shot the man two times. A photograph taken just moments after shows the homeowner--with his gun in hand--standing steps away from the man's lifeless body in his front yard. He was pronounced dead at the scene.




"We are investigating this as an attempted robbery," Sheriff Nehls said.

According to Nehls, two weapons were recovered at the scene, one from the homeowner and the other from the robber.

"This appears to be pretty cut-and-dry," Nehls added.

Nehls had a stern message for criminals coming from Harris County to Fort Bend County. Investigators have not confirmed if the dead man lived in Harris County.




"Don't come into Fort Bend County and start waving guns around because you could leave in a bag," Nehls said.

The deceased is described as a Hispanic man in his 20s. Neighbors say they saw a black truck with two people inside speed off from the scene.

"He did the right thing." said Sandra Ramirez of her neighbor. "People are ready to defend their homes."

Officers who responded found Dejean-Jones collapsed in an outdoor passageway, and he later died at a hospital. He was 23.

HARRIS COUNTY, Texas - The windows at the Your Jeweler store on Jones Road in northwest Harris County are shot out.

They were shattered in a gun battle at about 2:45 p.m. on Tuesday.


Harris County Sheriff's Office investigators said three men armed with pistols parked next door at a car wash and ran inside the jewelry store demanding money and jewelry from the owner.

"They began to beat him, pistol-whip him. At one point during the struggle, he managed to retrieve a pistol that was inside the store. He exchanged gunfire with the robbers," Lt. Thomas Gilliland, with the Harris County Sheriff's Office, said.

The owner told investigators that he believed he hit at least one of the three robbers before they left the store.

Investigators said a trail of blood led them to where the robbers' getaway car was parked at the car wash.

Investigators said one man showed up at a hospital with a gunshot wound and another man was discovered dead in a neighborhood near Coppergrove, west of the robbery scene.

Investigators said they believe all three locations are related.

"The shop owner has a right to defend himself and his property. It's fortunate that he wasn't hurt badly. He had a laceration on his head due to the pistol-whipping," Gilliland said.

Investigators said a third suspect remains on the run.
